Abstract

Given the inflation of criminal legislation in Brazil, this article examines Law 8.137/90, which defines crimes against the tax order, comparing it with the repealed Law 4.729/65. It analyzes the typicity of these offenses, which require specific intent to suppress or reduce tax, and the sanctions, which are stricter under the current law. It discusses the extinction of punishability through payment of the debt, repealed by Law 8.383/91. It concludes in favor of systematizing these crimes in the Special Part of the Penal Code, replacing custodial penalties with alternative ones, and preferring a conciliation system based on payment.
