Abstract

The author starts from the premise that the prisoner is a human person living a limit situation in prison, examining social contradictions regarding punishment and the dignity of the inmate. It aims to formulate rational principles guiding authorities in resolving riots with hostages while preserving everyone's life. The methodology is reflective-prescriptive, grounded in ethical-legal foundations and references to the Penal Execution Law and international law. It concludes that dialogue is the only valid means of settlement, that force is legitimate only in defence of persons under attack, and that all rules converge in the unity of Prisoner and Hostage in a single Human Face.
