The article examines the criminal representation established by article 83 of Law 9,430/96 as a procedural condition for criminal action in crimes against the tax order defined in articles 1 and 2 of Law 8,137/90. The exposition starts from the hermeneutic rule according to which there are no useless provisions in the law and examines the imperfections of the legal text, especially the silence regarding the police inquiry, the ownership of the representation, the statute of limitations, the prejudiciality and retroactivity. The investigation sustains that the representation constitutes a condition of the action related to the legal possibility of the request, preventing the opening of an inquiry without the manifestation of the offended party's will. The text concludes that the law binds ongoing inquiries and pending criminal actions, respecting the sphere of individual freedom.
