The article examines aspects of Law 9,296/96 concerning telephone interception, a topic discussed at the First Santa Catarina Seminar on Penal and Procedural Criminal Law. The exposition argues that interception of communication between the accused and their defense counsel is prohibited, based on articles 5, LXIII, and 133 of the Federal Constitution, the American Convention on Human Rights, and the Advocacy Statute, since the duty of secrecy is inherent to the right of defense. The text defends that the defense be informed of the interception's result immediately after the capture ends, under penalty of defense impairment. The investigation concludes that the defense's participation in the destruction incident must always be ensured.
