Joinder and continence in Law 9,099/95
Keywords:
Joinder, Continence, Special Criminal Court, Jurisdiction, Lesser offensive potentialAbstract
The article examines the application of the rules of joinder and continence to offenses of lesser offensive potential, governed by Law 9,099/95. The exposition argues that the jurisdiction of the Special Criminal Court was established at the constitutional level and that the rule of article 78, II, of the Criminal Procedure Code cannot refer such offenses to the Common Court, under penalty of offending the Constitution. The text analyzes the positions adopted in the judicial districts and concludes that, where there is joinder or continence between offenses of lesser offensive potential and others of a different nature, the severance of proceedings is required, with separate charges, and that, in material, formal, or continuing offense concurrence, a single charge must be filed in the Common Court.
