Abstract

The article comments on a decision of the Federal Supreme Court that ordered the archiving of a criminal representation against a Senator for crimes against honor, due to parliamentary immunity. The exposition reconstructs the historical evolution of the institute, from the Bases of the Portuguese Constitution of 1821 to article 53 of the 1988 Constitution, comparing the functional and spatial formulas and the French, English, and American traditions. The text argues that the 1988 Charter suppressed the restrictions of the exercise of the mandate and the exercise of functions, expanding the prerogative to cover the parliamentarian's political activity. The investigation concludes that the statements were made in the exercise of functions in a Parliamentary Inquiry Commission, with material immunity applying.
