Abstract

This study aims to analyze the case Fazenda Brasil Verde Workers, sentenced by the Inter-American Court of Human Rights in October 2016, in which Brazil was held responsible for the exploitation of slave labour in its territory, and ordered to pay compensation for victims and reopen the criminal investigations. In its sentence, the Inter-American Court recognized the existence, in Brazil, of historical structural discrimination on the grounds of economic position. A brief comparison will be drawn between the Inter-American standards and the national jurisprudence, addressing possibilities of using the precedent as a basis for legal thesis on behalf of slave labour victims in Brazilian criminal procedures.
