The paper aims to discuss methodological issues related to the comparative study of the american overcharging. Without departing from what usually happens in relation to the comparative analysis of the US legal system, the comparative study of overcharging has limitations and requires peculiar cautions. However, the use of methods that reduce the risk of misunderstandings and that facilitate a better understanding of the american legal institutes can significantly contribute to the achievement of the purposes of the comparative study.
