The article presents two different positions regarding the protection of prisoners during the coronavirus pandemic: Portugal created legal institutes towards the early release of inmates, containing the virus in prisons, whereas Brazil has an absence of policies aimed at protecting rights and guarantees, consequently increasing the national mortality of inmates.
