The impact of economic power on Brazilian criminal policy

This descriptive and explanatory article examines the influence of economic power on Brazilian criminal policy, with a focus on the drafting and enforcement of criminal norms in cases of white-collar crime. Using “Operação Lava Jato” as a reference, it analyzes the role of leniency agreements as instruments of economic rehabilitation and corporate reputation recovery, particularly in the cases of former Odebrecht and Andrade Gutierrez. The research adopts a qualitative methodology, based on documentary analysis and case study, drawing on primary sources such as leniency agreements, judicial decisions, and technical institutional reports, as well as secondary sources including books and scholarly articles. The data were collected through public consultation of official institutions, such as the Ministério Público Federal (MPF), Controladoria-Geral da União (CGU), and Tribunal de Contas da União (TCU).
