Luigi Ferrajoli and the 35 years of Diritto e Ragione: a small tribute to a great author and a great work

The purpose of this article is to pay tribute to Luigi Ferrajoli and to his book “Diritto e a Ragione: teoria del garantismo penale,” which turned 35 in 2024. The text seeks to demonstrate Ferrajoli’s importance in the contemporary legal landscape, recognizing him as one of the greatest legal philosophers of our time. Starting from a positivist conception—an heir to the Enlightenment tradition—Ferrajoli, who also served as a magistrate, accurately identifies the criminal sphere as a privileged locus to support his thesis that the law must be the “law of the weakest,” forging a system of guarantees focused on the defense of fundamental rights. Therefore, the article presents some of the author’s major works, emphasizing Diritto e Ragione due to its undeniable significance and its implications for the criminal justice system.
