STJ Topic 1331: the change in case law must be retroactive in favor of the defendant

This essay analyzes Repetitive Theme 1331 of the Superior Court of Justice, which discusses whether the change in case law should be applied retroactively in favor of the defendant. The Brazilian Institute of Criminal Sciences is in favor of this application, regardless of the defendant's explicit request, both to ongoing cases and to cases that have already been finalized, whenever the higher courts change their case law (stable set of decisions) on a question of constitutional, criminal or procedural law that impacts criminal cases.
