Abstract

Based on a new field of research, the corporate victimology (Laufer), this essay aims to debate the insufficiency of the Brazilian criminal justice system to face environmental disasters caused recently by mining companies. Then, it stresses the need of a new analytical category, the community dependence, and criticizes the strategic use of human rights to give voice to victim's needs. At the end, some emerging trends in the field of disasters law are outlined. Within this essay we propose some recommendations for future research on post-conflict social reconstruction.
