Although there is agreement on the fact that the defendant should be the last to speak in criminal proceedings, since this speech, which can influence the judge, translates the possibility to rebut the prosecutor’s allegations and thereby materialize the extension of the right of defense, the absence of legal writings about the chronology of “speeches” when there are whistleblowers and reported defendants should not create any difficulty to the realization of constitutional principles and guarantees. The reported defendant must always speak after the whistleblower. This article shows how an authoritarian interpretation of the legal regulation made a Car Wash judge realize the undue process of law. Also, it demonstrates the importance of habeas corpus as a legitimate mean of control of the due process of law to correct authoritarian deviations.
