“Anticrime” bill
the return of judicial arbitrariness

This brief analysis focuses on the claim of the so-called “anticrime project” to “combat” the crime phenomenon through changes in the codes that serve as a framework for the Brazilian criminal system: the Criminal Code and the Criminal Procedure Code. It is intended to demonstrate, taking into account that the legal dogmatic is not detached from its time and the transversal discourses that supports it, that the legislative proposal reinforces a fundamental theme of the Brazilian legal technicism: the judicial arbitrary.
