The “secret” of criminal judge impartiality

This article deals with the need for the criminal judge to exercise his jurisdicional activity in an impartial manner and committed to the rules established in the Brazilian criminal procedural system. In the current national context, where there is a heavy investment in relativizations of fundamental guarantees and false punitive solutions, it is essential that criminal prosecution be based on the principles enshrined in the 1988 Constitution. Thus, it is intended demonstrate that orchestrated action between criminal judge and the prosecution irreparably compromises the legitimacy of the decision-making acts regardless of the extent of their effects.
