The definition of action as a matter of philosophical grounding for the criminal scholars
rethinking the conceptual trajectory in criminal law theory

The paper argues against the alleged non-importance of the definition of action for the criminal scholars, shifting from a perspective of the conceptual trajectory as evolutionary to proposing it as a matter of philosophical grounding. In other words, from a philosophical perspective, there would be a question about the world and about the relationship between man–world, in the sense of asking ourselves if such a thing as an action exists and how can we know it. In its two sections, the paper aims to confront the intuitions we may have about the action, which return to the previous question, and examine two paradigmatic concepts in German criminal law theory (causalism and finalism), in order to trace the underlying theoretical-philosophical context that influenced what would be considered “real” and “objective.”
