This article aims to outline the updated framework of legal cooperation in Brazil, particularly regarding the international transfer of personal data for criminal prosecution purposes. Through case-law research and a literature review, the article analyzes the ADC 51 ruling, its impacts on national jurisprudence, and the recent data adequacy decision between Brazil and the European Union. ADC 51 consolidated an understanding already adopted by the courts, allowing direct data requests; the adequacy decision, in turn, excluded the processing of data for criminal purposes due to the absence of a “Criminal General Data Protection Law” (LGPD Penal). The article concludes that the advancement of legal cooperation depends on strengthening data protection, reinforcing the need for international dialogues and the approval of national legislation on the subject.
