The gender of punishment

The editorial analyzes female incarceration in Brazil from a gender perspective, highlighting that the country has the third largest female prison population in the world, with 44,421 women imprisoned in 2022. Data reveal that 68% are Black, 62% were arrested for drug trafficking in subordinate positions, and approximately 80% are mothers. The research evidences the overlap between criminalization and domestic violence, pointing out that more than half of incarcerated women had been victims of violence before imprisonment. It concludes by emphasizing the need to incorporate a gender perspective into the criminal justice system, with alternatives to incarceration and public policies that address the structural causes of female criminality.
