Abstract

This article analyzes the immediate effectiveness of acquittal in jury trials, focusing on guaranteeing the right to liberty and prohibiting the maintenance of detentions after a decision favorable to the defendant. Based on a literature review and analysis of Article 596 of the Code of Criminal Procedure, as well as the procedure adopted in Alagoas, it demonstrates a discrepancy between the determination of immediate release and the administrative practices of the system. It argues that custody for bureaucratic reasons constitutes illegal constraint and a violation of the principles of presumption of innocence, human dignity, and legality. It concludes that there is a need to improve the flows between the Judiciary and the prison administration, with the adoption of preventive measures that ensure the effectiveness of acquittal decisions and avoid undue detentions.
