Abstract

The article critically analyzes Article 29, paragraph 6, of Law 15,358/2026, which establishes the National Database of Ultraviolent Criminal Organizations, Paramilitary Groups, or Private Militias and provides that the inclusion of official identifiers in the registry shall presume a link with the respective organization for administrative, operational, and institutional cooperation purposes. Through bibliographic and documentary research, the paper investigates the extent to which this presumption moves beyond the predictive logic of criminal offenses toward the preemptive administration of subjects classified as risks. Drawing on critical literature on societies of control, data-driven governmentality, prediction, and preemption, it argues that the provision participates in an algorithmic and security-oriented rationality that turns presumed links into concrete effects of suspicion. The article concludes that the database may produce a permanent infrastructure of anticipation, capable of expanding the field of incidence of penal control over individuals and proximity networks, operating in a preemptive manner.
