The legal framework for combating organized crime and the punitivist logic of enemy criminal law

This paper analyzes the expansion of contemporary Criminal Law and its approximation to the logic of Enemy Criminal Law following the enactment of the Legal Framework for Combating Organized Crime. The research, based on bibliographic and normative analysis, draws on the contributions of Zaffaroni, Foucault, Baratta, and Jakobs and investigates how the new law institutionalizes the renunciation of legality, deepens penal selectivity, and renders “enemies” more vulnerable. The paper also analyzes the impacts of this model on the prison system, prisoners and their families, as well as on the expansion of criminality. The results indicate that punitive discourse, by fostering prejudice and operating according to a warlike rationale, produces discretionary violence and does not contribute to effective public security.
