The limits of weighing up principles, in the light of the example of imprisonment at second instance

During the years between Brazil´s Supreme Court rulings on the HC 126.292 and on the ADCs 43, 44 and 54, the position in favor of the possibility of one’s incarceration following a conviction sustained by a Court of Appeals was automatically incorporated by Courts all over the country. This phenomenon disregarded the limits of the ponderation of principles, which is not apt to offer universal and general solutions, applicable to each and any collision between the same two principles.
