Abstract

On 9 October, IBCCRIM filed a brief in Special Appeal No. 1.863.084/GO (STJ), which dealt with repetitive theme 1.063: "to examine whether it is the competence of the Jury Court to disqualify the crime of homicide committed while driving a motor vehicle from the intentional to the culpable mode, when drunkenness and disregard for traffic rules are proven".
The Institute took a position against the establishment of the thesis, analysing the issue from both a procedural and substantive perspective.
