criminal protection of mental integrity and self-determination in the age of neurotechnologies. New legal rights?

This article aims to analyze the necessity and legitimacy of criminal protection of so-called “neurorights,” notably mental integrity and self-determination, in the context of new neurotechnologies. To this end, the article begins with a brief contextualization of the main controversial aspects involving these new technologies and then address, through a comprehensive legal and bibliographic review, the foundations that legitimize the protection of mental integrity and self-determination by the legal-constitutional and criminal order. Finally, in order to better elucidate this recent topic, the criminal case presented in the episode The Entire History of You from the British series Black Mirror is chosen as a paradigm, from which the adequacy and sufficiency of the possible legal response applicable under our current legal system is questioned. This paper concludes that there are an emerging need and a considerable legitimacy for specific criminal protection of mental integrity and self-determination, given the partial inadequacy of the current Brazilian criminal legal system to adequately deal with the new risks arising from current and future neurotechnologies.
