Abstract

The article examines the influence of the Model Code of Criminal Procedure for Ibero-America on Latin American legislative reforms, confronting its fundamental guidelines with the new Italian criminal procedure and the Brazilian system. It analyzes the adoption of the accusatory model, the separation of procedural functions, due process guarantees, orality, popular participation, simplified procedures, regulated discretion and the judicialization of criminal enforcement. In Brazil, points of convergence are identified, as well as divergences, especially concerning the assessment of investigative elements and orality, indicating the directions to be followed by future reforms.
