Abstract

The historical evolution of Brazilian criminal legislation is traced, from the 1830 Criminal Code to the 1984 and 1990 reforms, noting that violent crime has not receded despite legislative efforts. Popular distrust in justice is pointed out as a factor increasing criminality, illustrated by concrete failures: extinction of tax punishability, multiplicity of laws on the same conduct, unpaid fines, unsupervised house arrest, retroactive prescription, appeal while at liberty, and prison overcrowding. It is concluded that joint social, legislative and judicial measures are needed, with a faster and stricter penal response, while acknowledging the limits of criminal law considered in isolation.
