Abstract

The article examines criminal protection of private life in Brazil, starting from constitutional recognition of intimacy as a fundamental guarantee. It analyzes legislation from the 1940 Penal Code to the 1983 Draft, which proposed crimes of intimacy violation and computer abuse. It finds that innovations did not succeed, keeping the system restricted to inviolability of domicile and correspondence. It concludes that the gap between technical progress and legislative delay demands criminal policy that reconciles technological development and protection of personality.
