Abstract

The text examines the inadmissibility of illegally obtained evidence in criminal proceedings, comparing Brazilian and North American positions. It analyzes the constitutional, legal, and doctrinal approach to illegally obtained evidence in Brazil, from the Imperial Constitution of 1824 to art. 5, LVI, of the 1988 Constitution, and the case law based on the principles of free conviction, public faith, and veracity of evidence. It examines the North American exclusionary rule, derived from the 4th, 5th, and 14th Amendments, and its evolution from Boyd, Weeks, and Mapp, as well as the purposes of exclusion and the fruits of the poisonous tree. It analyzes theoretical, operational, and practical problems, concluding with the need for awareness and courage to enforce the constitutional guarantee, under penalty of becoming a mere formula of words.
