Abstract

The text examines the scope of parliamentary immunity in Brazilian constitutional law, understood as a privilege arising from functional situations intended to ensure independence and security in the performance of the mandate, protecting the parliamentarian against political persecution disguised in the persecutio criminis. It analyzes the distinction between material immunity, provided in the caput of Article 53 of the Federal Constitution, and procedural immunity, set forth in § 1, demonstrating that the 1988 Constitution abandoned the conditions of previous Charters by establishing that deputies and senators are inviolable for their opinions, words and votes. It concludes that, absent express restriction, material immunity reaches the parliamentarian's political activity even outside Parliament, provided it is linked to the performance of political activity.
