Abstract

The text dogmatically reconstructs the criminal type of art. 89 of the Bidding and Administrative Contracts Law, which punishes illegal waiver or non-requirement of bidding and non-compliance with the pertinent formalities, analyzing related provisions, nomen iuris, protected legal interest, objective and subjective type, active and passive subjects and penalties. It argues that the protected legal interest is the Administration's interest in isonomy and in the selection of the most advantageous proposal, being a material crime of damage, instantaneous, with permanent effects, commissive or omissive and intentional. It concludes that the decision of the Court of Accounts declaring the illegality of the act functions as an extralegal objective condition of punishability, configuring what it calls the criminal-legal space of Courts of Accounts.
