Abstract

The text examines the reform of the Brazilian Criminal Code, starting from the 1940 statute and its Italian and Swiss influence, the adoption of custodial sentences and security measures and the crisis of the penitentiary system caused by the increase in crime and prison population. It analyzes the 1984 criminal reform, which extinguished the security measure for imputable offenders, introduced progressiveness in the execution of the sentence and restrictive penalties of rights, and Law 9,099/95, which established special courts and criminal transaction. It examines the reform of the Special Part, the gradual modernization of criminal legislation and the orientation of criminal policy, concluding with the distinction between violent and astute criminality.
