Abstract

The text examines the simplified police investigation as a democratic transition for the Brazilian police, starting from its Roman and canonical origin, its nature as a regime of force and its progressive weakening after the 1988 Constitution, which granted the Public Prosecution Service exclusivity of criminal action. It analyzes the flexibilization of the investigation, the legal foundation of simplification, with the abolition of continuation terms, and the histology of the simplified procedure, composed of the ordinance, the sitting term, the victim's statements, the qualification record and the interrogation. It concludes that the police investigation failed and that its abolition, with the municipalization of the police and the orientation of investigations by the Public Prosecution Service, is the path of the third millennium.
