Abstract

The decision examines a request for progression from the semi-open to the open regime and, in view of the notorious lack of halfway houses, arising from non-compliance with art. 203 of the Criminal Execution Law, grants the convicted person, on a precautionary basis, conditional release, instead of house arrest. It argues that the State's omission has caused harm to public security, criticizing irresponsible indulgence and the lack of political will to build prisons, and that the house arrest modality favors impunity by hindering control. It orders progression to the open regime, with conditions and a request for the Penitentiary Council's opinion, concluding that the measure best serves society and the convicted person.
