Abstract

The author examines the constitutionality and scope of article 190 of the Constitution of the State of São Paulo, which requires the transport of urban and rural workers by bus, in view of the Union's exclusive competence to legislate on traffic and transport. It aims to demonstrate that the state provision encroaches on federal sphere, is not self-executing and depends on statutory regulation, besides contradicting the regime of complementary norms, which require authorising complementary law. It analyses CONTRAN Resolutions and the socio-economic reality of rural workers' transport. It concludes that the provision is unconstitutional and that Resolution 683/87 is fully in force.
