Abstract

The author examines the Brazilian regime of telephone interceptions based on article 5, item XII, of the 1988 Constitution and Law 9,296/96, arguing that the constitutional wording was unduly restricted by the Drafting Committee, which creates a defect of competence and a breach of the legislative process. It analyses the requirement of a judicial order, legal reservation, the principle of proportionality, the fruit of the poisonous tree doctrine, the legal hypotheses of admissibility, deferred adversarial proceedings, the destruction of excerpts and criminal typification. It concludes that the law, though indispensable, is lacunar and defective, and that doctrine and case law must give it the best interpretation, harmonising security and defence rights.
