Abstract

The author examines the criminal amendments introduced by Laws 9,268 and 9,269/96, which modified articles 51, 78, 92 and 114 of the General Part and paragraph 4 of article 159 of the Special Part of the Penal Code, besides repealing provisions of the Penal Execution Law. It aims to demonstrate that the conversion of the fine into a debt of value, after res judicata, changes its legal nature into a civil credit of a public nature, forming part of the non-tax active debt, without application of the Tax Code, and that article 85 of Law 9,099/95 remains in force but is inapplicable for lack of regulation. It concludes that the amendments are, in general, advances, requiring systematic interpretation.
