Abstract

The author examines the thirty-day period, extendable for another thirty, of temporary imprisonment in heinous and similar crimes, provided for in article 2, paragraph 3, of Law 8,072/90, arguing its unconstitutionality for breaching the principle of reasonableness or proportionality, derived from substantive due process. It analyses the pre-cautionary nature of the measure, the requirement of reasoning, the need to specify the investigations dependent on custody and the flexibilisation of the period, understood as a maximum limit. It concludes that legal practitioners must order it with due weighting, not allowing thirty-day temporary imprisonment with a punitive character merely because of the label of heinous crime.
