Personal injury followed by death (art. 129, paragraph 3, Penal Code)
Keywords:
Personal injury, Preterintention, Causal link, Concurrent causes, ForeseeabilityAbstract
The author examines the preterintentional crime of personal injury followed by death, provided for in article 129, paragraph 3, of the Penal Code, in which the offender intends the minus delictum and causes the majus delictum, combining intent in the antecedent act and negligence in the result. It aims to analyse its elements, the foreseeability of the lethal event, the exclusion of attempt, the causal link and concurrent causes, in the light of the equivalence of antecedents theory adopted by article 13 of the Penal Code. It distinguishes per se from per accidens fatal injuries and examines absolutely and relatively independent causes. It concludes that death is imputable to the offender only when foreseeable, and that he answers for the antecedent act in cases of fortuitous event or force majeure.
