Abstract

The author examines the transformations of law in the face of the oil shocks of 1973 and 1979, economic globalization and the technological revolution, which disrupted the social-democratic model and challenged liberal constitutionalism and the balance between powers. It aims to demonstrate the replacement of the normativist conception of law as a closed logical-formal system by the network configuration, marked by the multiplicity of sources, the provisional nature of norms and legal pluralism. It analyses the State's identity crisis and the regulatory trilemma of German legal sociology. It concludes that a new normative rationality is needed, ensuring governability and inter-organizational balance, protecting marginalized sectors.
