Abstract

The author reconstructs the second part of the Sacopã crime proceedings, which took place in 1952 in Rio de Janeiro, in which Lieutenant-Aviator Alberto Jorge Franco Bandeira was convicted of the death of banker Afrânio Arsênio de Lemos. It aims to analyse the indictment, the mandatory preventive detention, the trial by the Jury Court, the conviction to fifteen years' imprisonment, the dismissal of the appeal, the partial serving and extinction of the penalty, and the habeas corpus filed before the Supreme Federal Court in 1972. It analyses the justices' votes, the Public Prosecution Service's opinion and the memorial by lawyer Sousa Neto. It concludes that, by majority, the Second Panel granted the order to annul the trial, given the extreme singularity of the case, without acquitting the defendant.
