Abstract

The article examines the changes brought by Law 9,268/96 to the enforcement of the fine as a criminal penalty in Brazilian criminal law. The exposition starts from the historical foundation of the pecuniary penalty and the new wording of article 51 of the Criminal Code, which considers the fine a debt of value after the final judgment, subjecting its collection to the rules of the public treasury's active debt. The investigation analyzes the issue of the convict's insolvency, the tax procedure and criminal guarantees, the effects of non-payment, the limitation periods, retroactivity and the interrupting and suspending causes. The text concludes that the fine remains a criminal sanction, although its collection has been civilized, and that its cumulation with imprisonment proves unsustainable.
