Abstract

The article examines the attribution for conducting preliminary investigations in criminal proceedings, analyzing the confrontation between the English and continental systems and the position adopted by Brazilian law. The exposition starts from the decisions of the European Court of Human Rights on the guarantee of a fair trial and equality of arms, and examines the risks of accumulating functions in a single body, with support in Altavilla's judicial psychology. The investigation sustains that the Brazilian system opted for the differentiation of functions, with the judicial police responsible for conducting the inquiry and the Public Prosecution Service responsible for bringing the criminal action. The text concludes that the prosecution service cannot directly conduct criminal investigations, under penalty of usurping police attributions.
