Abstract

The article examines Brazilian traffic legislation and the need for its updating, starting from the observation that the Traffic Code remains unknown and unenforced. The exposition reconstructs the historical evolution of legislation on motor vehicles, from Decree 8,324 of 1910 to the National Traffic Code of 1966, and examines the long legislative process that resulted in the new Brazilian Traffic Code. The investigation analyzes the culpable characteristic of automobile crimes, the deficiency of enforcement and the certainty of impunity, with support from authors such as Waldyr de Abreu, Nelson Hungria and José Frederico Marques. The text concludes by the need for education and discipline in traffic.
