Abstract

The article examines the legal qualification of street racing when homicide or bodily injury results from it, inquiring whether the participants respond on grounds of negligence or eventual intent. The exposition starts from the administrative penalties provided for in the National Traffic Code and examines the meaning of street racing as extremely dangerous and violent conduct, both for those who participate in it and for third parties. The investigation sustains, with support from Hungria, Zaffaroni and Jimenez de Asúa, that eventual intent is close to conscious negligence and that the participants in street racing show themselves indifferent to the consequences of their gesture. The text concludes by the characterization of eventual intent and by the need for rigorous criminal sanction.
