Abstract

The article examines article 10, § 1, II, of Law 9,437/97, which typifies the conduct of using a toy gun or simulacrum of a weapon capable of frightening others to commit crimes. The exposition starts from the doctrinal and jurisprudential divergence on the robbery aggravating factor and analyzes the consequences of creating the new autonomous type, which generates formal concurrence of crimes and leads to paradoxical situations, with more severe punishment for the use of a simulated weapon than of a real weapon. The investigation examines doubly qualified robbery, the use in other crimes, the inapplicable provision of item IV, the cause of penalty increase and the repeal in the Criminal Misdemeanors Law. The text concludes by the need for restrictive interpretation.
