Abstract

The article examines whether Law 9,455/97, by defining the crimes of torture and establishing their restrictive regime, repealed article 2 of Law 8,072/90, which imposed criminal and procedural restrictions on heinous and similar crimes. The exposition analyzes the constitutional mandate of article 5, XLIII, which equated torture, trafficking, terrorism and heinous crimes, and sustains that the later law entirely regulated the matter, being incompatible with the previous one. The investigation demonstrates that the coexistence of the two laws would generate unequal and absurd treatments between crimes of equivalent gravity. The text concludes by the tacit repeal of article 2 of Law 8,072/90.
