Abstract

The article examines the conflict between the defendant's will not to appeal and the filing of the appeal by the technical defense. The exposition presents the two doctrinal and jurisprudential currents, one favorable to the prevalence of the defendant's will, as the holder of the right to appeal, and another favorable to the prevalence of the technical defense. The investigation sustains the latter position, based on the legitimacy of the defender provided for in article 577 of the Criminal Procedure Code, on the prevalence of the technical defense over self-defense, on the constitutional guarantee of full defense with the means and resources inherent to it and on the prohibition of reformatio in pejus. The text concludes that the defendant's will does not prevail when unavailable rights are at stake.
