Provisional execution
Keywords:
Provisional execution, Devolutive effect, Presumption of innocence, Penal Execution Law, Drug traffickingAbstract
The article examines the possibility of provisional execution of the condemnatory decision when extraordinary appeals are received only with devolutive effect. The exposition analyzes a judgment of the Federal Supreme Court that denied habeas corpus in favor of convicts for drug trafficking, with support from the Court's reiterated case law and article 35 of Law 6,368/76. The investigation comments on the decision and sustains that provisional execution does not violate the presumption of innocence, being harmful to the convict only the distinction between preventive detention and serving the sentence. The text concludes by the admissibility of early execution and by the application of the Penal Execution Law to the provisional prisoner.
