The Public Prosecution Service in criminal proceedings

The article examines the legitimacy of the Public Prosecution Service to file an appeal in favor of the defendant, based on a judgment of the Superior Court of Justice that heard and granted a special appeal so that an appeal not heard by the lower court could be examined. The exposition analyzes the relator's reasoning, according to which the Public Prosecution Service is not an accuser in the vulgar sense of the term and is not legally against the defendant, since it seeks the real truth and a just decision. The investigation sustains that the functions of dominus litis and custos legis are not dissociated and that the institutional interest is public. The text concludes by the legitimacy of the appeal in favor of the accused.
